Welcome to the Privacy Policy of Watermove.
Watermove and www.watermove.com.au
is operated by Goulburn-Murray Water.
Your privacy is important to Watermove. As part of the normal operation of its
services Watermove collects, uses and, in some cases, discloses information
about you to third parties. This Privacy Policy governs the information
Watermove collects about you and your use of information it provides to you.
Information that Watermove Collects
Watermove’s primary purpose in collecting personal information is to provide an
efficient service. Watermove only collects personal information about you that
it considers necessary for this purpose.
To trade water on Watermove’s water exchange, you will need to provide Watermove
with your personal information, contact information and other information
necessary to complete a water trade.
Under some circumstances Watermove may require some additional necessary
financial information. If you submit an offer to buy water, Watermove may
collect from your Water Authority ("WA") full details of your financial
transactions with that WA during the current financial year and the previous
financial year. Watermove uses this financial information to verify the
financial position of buyers seeking to purchase water on Watermove.
Watermove may also require people seeking to buy water on Watermove to consent
to the release of credit information. If this is required, traders will be
requested to consent to the release of credit information and personal
information provided by traders may be disclosed to a Credit Reporting Agency
for the purposes permitted by the Privacy Act 1988 as amended by the Privacy
Amendment Act 1990.
What Watermove Does with Your Personal Information
Watermove uses personal information about you (including but not limited to the
information in the file it maintains about you, and other information it
obtains from your current and past activities with Watermove) to conduct water
exchanges, ensure compliance with its Operating Rules and to provide an
efficient service.
If you choose to trade water on Watermove, your address and other information is
used to invoice you and provide associated support.
By trading on Watermove you expressly agree that Watermove may use your
information to contact you and deliver information to you, such as
administrative notices and communications relevant to your use of Watermove.
Watermove may collect water trading details to create summary statistics that
will be used for research into trading patterns. Any summary statistics
provided will not identify users except in compliance with a law enforcement
direction (refer "Legal Requests" section).
Disclosure of Your Information by Watermove
Although Watermove uses industry standard practices to protect your personal
information, due to technical limitations, Watermove cannot ensure that all of
your private communications and other personal information will never be
disclosed in ways not otherwise described in this Privacy Policy. By way of
example (without limiting the foregoing), Watermove may be forced to disclose
information to the government or third parties under certain circumstances
(refer "Legal Requests" section), or third parties may unlawfully intercept or
access transmissions or private communications. Therefore, although Watermove
uses industry standard practices to protect your privacy, it cannot and does
not guarantee, and you should not expect, that your personal information or
private communications would always remain private.
As a matter of policy, Watermove does not sell or rent any personal
information about you to any third party. However, the following describes some
of the ways that your personal information may be disclosed, and by trading
with Watermove you expressly agree that your personal information may be
disclosed by Watermove in the following ways:
Water Authorities. Personal information will be disclosed to the
relevant WA for each buyer and seller at the time of such buyer or seller
entering their offer, to ascertain if such a trade would be acceptable to the
WA.
Internal Service Providers. Watermove may use internal service
providers to facilitate its services (e.g., search, discussion boards, surveys)
and therefore it may initially provide your name and contact details directly
to them. In some instances, the internal service provider may collect
information directly from you (such as the situation where Watermove asks an
internal service provider to conduct a survey for it). In these cases, you will
be notified of the involvement of the internal service provider, and all
information disclosures you make will be strictly optional. In all cases, these
internal service providers' use of information Watermove supplies to them is
restricted by confidentiality agreements. If you provide additional information
to an internal service provider directly, then their use of your information is
governed by their applicable privacy policy.
Legal Requests. Watermove may lawfully disclose your personal
information for law enforcement or regulatory purposes. Watermove cooperates
with law enforcement inquiries and other third parties to enforce laws,
intellectual property and other rights. It can (and you authorise it to)
disclose any information about you to law enforcement or other governmental
officials as Watermove, in its sole discretion, believes necessary, appropriate
or as otherwise permitted under the Privacy Act 1988 (Cth), in connection with
an investigation of fraud, intellectual property infringements, piracy or other
activity that is illegal or may expose Watermove to legal
liability.
Your Use of Other Users' Information
By using Watermove’s services, you agree that, with respect to other users'
personal information that you obtain through a Watermove-related communication
or Watermove-facilitated transaction, you shall use that personal information
only as allowed by this Section.
In relation to such personal information, Watermove hereby grants to you a
license to use such information only for the purposes of that particular
transaction, or any other purpose that the user to whom the personal
information relates expressly permits after adequate disclosure of the
purpose(s).
In addition, under no circumstances, except as defined in this Section, can you
disclose personal information about another user to any third party without
Watermove’s consent and the consent of such other user after adequate
disclosure.
Changing your personal information
You can change the information you have submitted to Watermove including your
information such as: name, company, address, business phone number, home phone
number, mobile number, fax number, email address.
You must promptly notify Watermove of any changes to your personal information.
Upon your request, Watermove will deactivate your trader information, contact
information, and financial information from its active databases.
To make any changes to any of the above information, please contact the
Watermove Supervisor on telephone 1300 850 099 and request details on
how to deactivate your account or amend your personal details.
Watermove will retain in its files information you have requested to remove in
some circumstances, such as to prevent fraud, resolve disputes, assist with any
investigations, enforce its Operating Rules, and to comply with legal
requirements. Further, such prior information is never completely removed from
Watermove’s databases due to technical constraints and the fact that Watermove
backs up its systems. Therefore, you should not expect that all of your
personal information will be completely removed from its databases in response
to your requests. However, such information will only be available to select
Watermove personnel.
Security
Your Information is stored on Watermove’s server located at Tatura, Victoria,
Australia. Watermove uses industry standard efforts to safeguard the
confidentiality of your personal information, such as firewalls and Secure
Socket Layers. However, "perfect security" does not exist on the Internet.
Other information collectors
Except as otherwise expressly discussed in this Privacy Policy, this document
only addresses the use and disclosure of information Watermove collects from
you. To the extent that you disclose your information to other parties, whether
they are buyers or sellers on the Watermove Site or other sites throughout the
Internet, different rules may apply to their use or disclosure of the personal
information you disclose to them. Since Watermove does not control the privacy
policies of third parties, you are subject to the privacy policies of that
third party. Watermove encourages you to ask questions before you disclose your
personal information to others.
